2. Personal data collected
LAUSADENT collects and processes the following categories of personal data,
depending on the context of the interaction:
2.1 Data provided voluntarily
- First name, last name
- Company name (company, laboratory, practice, hospital)
- Professional e-mail address
- Professional telephone number
- Professional postal address
- Content of messages sent via the contact form
- Order and invoicing data (in the context of a business relationship)
2.2 Data collected automatically
When visiting the website, certain technical data is collected automatically:
- IP address (anonymised or pseudonymised where applicable)
- Browser type and version
- Operating system
- Date, time and duration of the visit
- Pages viewed and navigation path
- Referring site (origin page)
- Cookie and similar technology data (see our Cookie policy)
3. Purposes of processing
In accordance with the purpose principle (Art. 6 para. 3 FADP / LPD), personal data is
processed for the following purposes:
- Responding to contact requests: processing of messages received via the contact form, preparation of tailored commercial proposals
- Performance of contracts: management of orders, deliveries, invoicing, follow-up of technical support services
- Customer relationship management: monitoring of exchanges, interaction history, communication relating to products and services
- Website improvement: statistical analysis of traffic and browsing behavior, optimization of content and performance
- Security: fraud prevention, protection against unauthorized access, maintenance of the integrity of the website
- Legal obligations: retention of accounting and business data in accordance with Swiss law (Art. 958f CO)
Data is not used for mass direct marketing,
automated profiling for targeted marketing purposes, nor sold to third parties.
4. Legal basis for processing
In accordance with Art. 31 FADP / LPD, the processing of personal data by LAUSADENT
is justified on the following grounds:
- Performance of a contract or pre-contractual measures (Art. 31 para. 2 let. a FADP / LPD):
processing of orders, quotations, services and customer follow-up
- Overriding private interest (Art. 31 para. 1 FADP / LPD):
website improvement, statistical analysis, legitimate business communication
- Consent (Art. 31 para. 1 FADP / LPD):
voluntary submission of the contact form, acceptance of non-essential cookies
- Legal obligation:
retention of accounting and business data in accordance with Swiss law
5. Retention period
Personal data is kept for as long as necessary to achieve
the purposes for which it was collected, in accordance with the proportionality principle
(Art. 6 para. 4 FADP / LPD):
- Contact form data: up to three (3) years after the last meaningful exchange, unless an ongoing business relationship exists
- Contract and invoicing data: ten (10) years from the end of the contractual relationship, in accordance with Swiss accounting obligations (Art. 958f CO)
- Browsing and cookie data: according to the periods indicated in the Cookie policy (session to a maximum of 24 months)
- Business correspondence data: five (5) years after the last exchange
At the end of these periods, the data is deleted or irreversibly anonymised.
6. Recipients and disclosure of data
The personal data collected is intended primarily for LAUSADENT
for the purposes described above. It may be disclosed to the following categories
of recipients, to the extent necessary:
- Technical service providers: website host (Infomaniak Network SA, Switzerland),
messaging service providers and management tools
- Business partners: manufacturers and suppliers, in the context of fulfilling
an order or support service requiring their involvement
- Authorities: Swiss judicial or administrative authorities, where required by law
These recipients are bound by a duty of confidentiality and may only use
the data within the strictly defined scope of their assignment. LAUSADENT does not sell,
rent or transfer personal data to any third party for commercial purposes.
7. Data transfers abroad
As a rule, personal data is processed and stored in Switzerland.
However, certain technical service providers (for example Google Fonts for the loading
of the font) may result in data being transferred to servers
located outside Switzerland.
In accordance with Arts. 16 and 17 FADP / LPD, any transfer of data abroad is only carried out
if the destination state has an adequate level of protection recognized by the Swiss Federal Council,
or if appropriate safeguards are in place, in particular:
- Standard contractual clauses recognized by the Federal Data Protection and Information Commissioner (FDPIC / PFPDT)
- Explicit consent of the data subject after being informed of the risks
- Necessity for the performance of a contract
The list of states with an adequate level of protection can be consulted
on the FDPIC website (www.edoeb.admin.ch).
8. Data security
In accordance with Art. 8 FADP / LPD, LAUSADENT implements appropriate technical and organizational
measures to protect personal data against any unauthorized processing,
loss, destruction or accidental damage, in particular:
- Encryption of communications (HTTPS/TLS protocol)
- Hosting with a certified Swiss provider (Infomaniak)
- Restriction of access to data to authorized persons only
- Regular backups
- Updating of systems and software components
Despite these measures, no system is completely free of risk.
It is recommended not to send nominative medical data or particularly sensitive data,
within the meaning of Art. 5 let. c FADP / LPD, via the contact form.
9. Rights of data subjects
In accordance with the Swiss FADP / LPD, you have the following rights regarding your personal data:
- Right of access (Art. 25 FADP / LPD): you may ask LAUSADENT to confirm
whether personal data concerning you is being processed and, if so, obtain a copy of it
- Right to obtain or transfer data (Art. 28 FADP / LPD): you may request
that your personal data be provided to you in a commonly used electronic format or transferred
to another controller
- Right to rectification (Art. 32 para. 1 FADP / LPD): you may request the correction
of inaccurate personal data concerning you
- Right to erasure (Art. 32 para. 2 let. c FADP / LPD): you may request the deletion
of your personal data where its processing is no longer justified or where it infringes the FADP / LPD
- Right to object: you may object to the processing of your data
for legitimate reasons related to your particular situation
To exercise these rights, send a written request to LAUSADENT at the address indicated in Article 1,
enclosing a copy of an identity document. LAUSADENT will respond within thirty (30) days.
In the event of disagreement or if you consider that the processing of your personal data infringes the FADP / LPD,
you have the right to lodge a complaint with the Federal Data Protection and Information Commissioner
(FDPIC / PFPDT):

The website uses cookies and similar technologies to ensure its proper functioning,
improve the user experience and carry out statistical analyses.

11. Data of minors
The LAUSADENT website is intended for professionals in the dental sector and private customers (B2B and B2C).
LAUSADENT does not knowingly collect personal data from minors.

LAUSADENT reserves the right to amend this privacy policy at any time,
in particular to take account of changes in the legal framework, the technologies used or the services offered.
Amendments take effect as soon as they are published on the website. In the event of a material change
affecting the rights of data subjects, appropriate information will be provided.

13. Governing law and jurisdiction
This privacy policy is governed exclusively by Swiss law,
in particular the Swiss Federal Act on Data Protection (FADP / LPD, RS 235.1)
and its implementing ordinance (OPDo).
Any dispute relating to the protection of personal data shall be submitted to the
exclusive jurisdiction of the ordinary courts of the district of Lausanne, canton of Vaud, Switzerland,
subject to any mandatory forum provided for by law.
